Anyone ever have their car re-possessed?
They can come and pick your car up at anytime if you have not made a payment. My son had a friend who was 14 days late and they came in the middle of the night to take the car. Here is what happened to us. We were behind on one payment and they did call everyday, we did not ignore their calls. They were to send us papers to rewrite the loan. We filed bankruptcy on 3-30-09. On 3-31-09 the bank was notified of the filing on 4-5-09 the repo guys came to get the vehicle. They were given a key by the bank but it did not work-which really pissed them off. They thought that it would be an easy take and no one would know until we woke up in the morning to see it gone. So they started to bang on the door and demanded we give them the key which I would not give them because of there being a stay because of bankruptcy. They also had a truck with them that would tow the vehicle. We called the cops because of their behavior. Lots of things happened that night that the bank will now be liable for. I don't know what will happen for you or what the best thing for you to do is, but I would suggest that if you have a garage you put the vehicle in the garage and close the door and don't drive it until you can figure out what to do. They can follow you and pick it up at anywhere if you leave the vehicle. Come out of the grocery store or work and the car is gone. Even if you voluntarily turn the car in your credit will still be impacted. I know how you feel and believe me you are not alone in this situation. We by the way got the vehicle back because we filed bankruptcy and the bank should not have authorized the repo It does not matter how much you have left to pay, You will be responsible for the remaining balance if they sell the car for less that is still owed. Everyone says talk to the bank they will work with you. Well no in all cases they don't. Good luck to you.
